FAO - Africover User Agreement

The data that you have selected belongs to the public domain Africover data and can be accessed accepting the User Agreement for non commercial use of Africover public domain data.

After accepting the following agreement, you will have to fill a form to register in our system. You will receive an e-mail message containing the data and instructions required to log in the system and download the data from our server*.

USER AGREEMENT
 
Please read these terms and conditions before accessing or using the Africover Public domain data .
 
1. General

This User Agreement sets forth the terms and conditions of a license for you to use Africover public domain data, the spatially or thematically aggregated version of the land cover Multipurpose Data base on Environmental resources produced by the Africover project (hereinafter referred to as "Africover public domain data").

Africover Public domain data are defined according to the Guidelines for custodianship as spatially or thematically aggregated versions of the full resolution land cover Multipurpose Data base on Environmental resources produced by the Africover project. The Africover public domain data has reduced information content compared to the full resolution data. It can be accessed free of charge within this User Agreement.

This User Agreement covers the use of this version of Africover public domain data or any other subsequent versions of it that may be accessible in the future. By accessing and/or using Africover public domain data, you consent and agree to comply with all of the terms and conditions of this User Agreement.

The rights and obligations concerning use of Africover public domain data in accordance with this User Agreement is personal to you or to the institution on behalf of which you are acting and is not transferable to any other person or entity. The user name and password that are provided to log in the reserved area of the site and download the data are confidential and cannot be transferred to a third party for any reason or under any circumstances.

From time to time, Food and Agriculture Organization of the United Nations (hereinafter referred to as FAO).

FAO may modify these terms and conditions. Accordingly, please continue to review the terms and conditions whenever accessing or using Africover public domain data, since any use by you after any such changes, modifications, or additions shall be governed by this User Agreement.

2. Non commercial use and reciprocity principle

Commercial use of data is defined according to the Guidelines for Custodianship as 'for a purpose relating to trade and the buying, selling or exchange of information commodities for profit'. It covers situations where a request for information is received where the intention is to use the information to:

* arrive at a commercial decision based upon this information
* gain competitive advantage over others
* provide a third party with a competitive advantage over others
* create a value-added information product for commercial purposes
* produce profit providing the information to third parties as they are

The Licensee warrants that the data is used for non-commercial purposes (i.e. excluding the before mentioned conditions of commercial use) and will not be sold, traded or transferred in any way except under the terms of this contract.

As a part of the agreement for the use and access to the public domain data, according to the guidelines for custodianship and on the base of the principle of reciprocity, the Licensee is requested to share with FAO and the Africover Project any validated value added to the data: this comprises for example the detection of any errors, the outcomes of applications generated with the data and updates of the original data.

3. Usage

The right to use the Africover public domain data is non-exclusive and non-transferable and except in the circumstances described below the data cannot be transferred to a third party under any circumstances.

Property over the information or works shall at all times remain the property of FAO and each of the participating countries.

FAO holds copyright over Africover public domain data or any other proprietary information contained in it, which are protected by copyright laws and regulations worldwide. FAO hereby grants you a license to use Africover public domain data, and to print the materials that are the result of the use of Africover public domain data solely for non commercial purposes and in accordance with this User Agreement.

The Licensee shall ensure that all products developed from or incorporating the supplied information, works or part thereof, bears an acknowledgment that FAO and the relevant country are the owners of the copyright of that information or works, and the Licensor is the source of the supplied information or works.

This data may be transferred to a third party for non-commercial work or educational purposes providing the Licensor approves and under such conditions as the Licensor may set.

4. Disclaimer of Warranty; Limitations on Liability.

You expressly acknowledge and agree that any and all use of Africover public domain data is at your sole risk. neither FAO, its affiliates, or any of their respective employees, agents, third-party content providers, or licensors warrant that access to and use of Africover public domain data will be free from interruptions or free from errors; nor do they make any warranty as to the results that may be obtained from use of  Africover public domain data, or as to the accuracy, reliability, or content of any information or service provided through  Africover public domain data.

Africover public domain data is provided "as is" without any warranties of any kind, either express or implied, including but not limited to warranties of title or implied warranties of merchantability or fitness for a particular purpose. The limitations and characteristics of the data is are documented in the metadata . In no event shall FAO be liable to you or any other person for any loss of business or profits, or for any indirect, incidental or consequential damages arising out of any use of, or inability to use,  Africover public domain data, even if FAO was previously advised of the possibility of such damages, or for any other claim by you or any other person.
 
You acknowledge and agree that the delivery system used for the Africover public domain data, i.e., the Internet and the World Wide Web, are unpredictable and may, from time to time, impede access to Africover public domain data. You acknowledge and agree that FAO is in no way responsible to you in any way whatsoever for any interference with your use of or access to Africover public domain data and you expressly waive and forever discharge and release any and all claims against FAO in connection therewith.
 
5. Indemnification

By using Africover public domain data, you agree to defend, indemnify, and hold harmless FAO, its affiliates and respective directors, officers, employees, and agents from and against all claims and expenses, including attorneys' fees, arising out of the use of Africover public domain data by you or by anyone having access to Africover public domain data by means of your Account.
 
6. Termination

Either you or FAO may terminate this User Agreement at any time, effective immediately, with or without prior notice to the other party. Termination of this Agreement automatically terminates your license to use Africover public domain data and any content or other material contained therein. The provisions of Section 3, 4, 6 and 7 shall survive any termination of this User Agreement.
 
7. Governing Law; Disputes

This User Agreement shall be governed by general principles of law, to the exclusion of any single national system of law. Any dispute, controversy or claim arising under or pursuant to this User Agreement shall be settled by mutual agreement. If FAO and you are unable to reach agreement on any question in dispute, either party shall have the right to request arbitration in accordance with the Arbitration Rules of the United Nations Commission on International Trade Law. FAO and you agree to be bound by any arbitration ruling rendered in accordance with the above, as the final adjudication of any such dispute. Nothing contained in or related to this User Agreement shall be deemed a waiver, express or implied, of the privileges and immunities of FAO.
 
8. Miscellaneous

This User Agreement and any FAO policies relating to your operation and use of Africover public domain data constitute the entire agreement and understanding between FAO and you with respect to the subject matter hereof. The provisions of this User Agreement shall inure to the benefit of FAO, its affiliates, and its third-party content providers and licensors. No waiver by any party hereto of any of the provisions hereof or of any breach or other default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default.

* FAO and the Africover Project reserve the right to restrict the access to the reserved area for users that have been violating the User Agreement.
